Rules for buying and selling goods in the online store Dvirtex.lt

1. GENERAL PROVISIONS
1.1. These purchase and sale rules (hereinafter - the Rules) determine the mutual rights, duties and responsibilities of the person purchasing goods in the www.dvirtex.lt e-store (hereinafter - the Buyer) and UAB "DVIRTEX" (hereinafter - the Seller), when the buyer purchases goods in the electronic store . By purchasing goods in the online store, the Buyer agrees to the application of these Rules.
1.2. The buyer confirms the Rules after having familiarized himself with them and checking the box next to the statement "I agree with the terms of use of Dvirtex.lt". The Rules approved in this way are a binding legal document for the Parties, which determine the rights and obligations of the Buyer and the Seller, the terms of purchase and payment for goods, the order of delivery and return of goods, the responsibility of the parties and other conditions related to the purchase and sale of goods on Dvirtex.lt.
1.3. Only Buyers who meet the following points have the right to buy Dvirtex.lt: 1) an actionable person, i.e. a person who has come of age, whose capacity is not limited by court order; 2) a minor between fourteen and eighteen years of age who has the consent of his parents or guardians, except in cases where he is emancipated; 3) legal entity; 4) duly authorized representatives of all the above-mentioned persons.
1.4. The prices of goods in the Dvirtex.lt online store are indicated in euros, including the amount of VAT valid at the time according to the legislation. The prices of goods in the Dvirtex.lt online store may differ from the prices of goods in physical stores.
1. RIGHTS AND OBLIGATIONS OF THE BUYER
1.1. The buyer has the right to purchase goods from the electronic store dvirtex.lt in accordance with the procedure established by these Rules.
1.2. The buyer has the right to refuse the order in accordance with the procedure established by these Rules.
1.3. The buyer has the right to exchange or return the purchased goods in accordance with the rules.
1.4. The buyer must provide complete and correct data in the online store registration and purchase form. If the personal data of the Buyer has changed and the Seller is not informed about it, the Buyer assumes all the risk of losses arising from this.
1.5. The buyer undertakes to comply with these Rules and the procedure established by the legal acts of the Republic of Lithuania.
1.6. The buyer must pay for the ordered goods or services and accept them in accordance with the procedure established by these Rules. After choosing to pick up the goods at the Store, the Buyer must pick them up at the chosen Store within the terms specified in the Rules.
2. RIGHTS AND OBLIGATIONS OF THE SELLER
2.1. Under the conditions stipulated in the rules, the Seller undertakes to provide the goods ordered by the Buyer and to accept the goods returned by the Buyer.
2.2. The Seller has the right to cancel the order without prior notice to the Buyer, if the Buyer does not pay for the goods within 3 (three) working days using the payment method provided.
2.3. In the event of uncertainty regarding the information provided in the order, the Seller has the right to contact the Buyer using the details specified in the order. In this case, the term of delivery of the goods starts counting from the day of contact with the Buyer. The Seller has the right to cancel the Buyer's order without prior notice:
2.3.1. if the Seller fails to contact the Buyer within 2 (two) working days after placing the order;
2.3.2. if the Buyer does not provide the Seller with the requested information within the deadline specified by the Seller;
2.3.3. if the Buyer does not give the Seller consent to check his personal data.
2.4. If false, inaccurate, misleading or not all the requested data is submitted during registration or later, or the Buyer does not comply with other obligations provided for in these Rules, the Seller has the right to immediately cancel the registration and delete the Buyer's data or limit the Buyer's right to use e-mail. services provided by the store. The Buyer is solely responsible for the consequences caused by incorrect data provided by the Buyer.
2.5. If the Seller is unable to deliver the ordered product to the Buyer due to unforeseen circumstances, he undertakes to offer the Buyer an analogous product or a product that is as similar as possible. If the Buyer refuses to accept the product, which was offered as analogous or similar, the Seller undertakes to return the money paid to the Buyer within 14 (fourteen) working days, if prepayment was made, and in all cases to cancel the order.
2.6. The Seller undertakes to respect the Buyer's privacy. Personal data of the Buyer shall be processed only in accordance with the Rules, Privacy Policy and legal acts of the Republic of Lithuania.
2.7. The Seller undertakes to fulfill other obligations imposed on the Seller in the Rules, Privacy Policy and legal acts of the Republic of Lithuania.
3. ORDERING, PURCHASE - SALE OF GOODS
3.1. The buyer can order and buy goods in the Dvirtex.lt online store by choosing one of the following methods:
3.1.1. by registering online at Dvirtex.lt (by entering your registration name and password);
3.1.2. without registering online at Dvirtex.lt;
3.1.3. by phone call;
3.1.4. in physical Dvirtex stores.
3.2. When ordering goods, the buyer must indicate (dictate) the personal data necessary for the proper execution of the goods order provided for in the Privacy Policy in the relevant information fields provided by the Seller.
3.3. The provisions of the Rules and Privacy Policy apply to Buyers who have placed an order for goods by phone or in Stores. By placing an order, they agree to the Rules.
3.4. When the Buyer, after choosing the goods or services to be purchased and creating a basket of goods, completes all the steps of the order, the last of which is the selection and confirmation of the payment method, it is considered that a purchase-sale legal relationship has arisen between the Seller and the Buyer and a purchase-sale contract has been concluded. The Seller sends the Buyer a link to the valid Rules together with the order confirmation to the e-mail address specified by the Buyer.
3.5. Each Buyer's order is stored in the Dvirtex.lt database.
4. PAYMENT FOR GOODS
4.1. The Buyer can pay for the ordered goods in one of the following ways (the choice may be limited at the Seller's discretion):
4.1.1. using the online banking system (Paysera);
4.1.2. by advance bank transfer;
4.1.3. in cash or by bank card when picking up goods in Dvirtex stores;
4.1.4. using the service of conclusion of consumer credit agreements provided by leasing companies.
4.2. By approving the Rules, the Buyer agrees that the documents for the purchase of goods - VAT invoices, which are also the goods' warranty vouchers - will be submitted to him electronically to the e-mail address specified in the Buyer's registration form immediately after the completion of the order. VAT invoices indicate the selected goods, their quantity, discounts granted, the final price of the goods, including all taxes, and other data required to be approved by legal acts regulating accounting.
5. DELIVERY, COLLECTION OF GOODS
5.1. When ordering goods, the Buyer can choose one of the following delivery methods:
5.1.1. delivery of goods to the address specified by the Buyer (to the home);
5.1.2. delivery of goods to DPD PickUp parcel terminals.
5.2. The seller undertakes to deliver the goods ordered by the buyer in the territory of Lithuania within 1-10 working days.
5.3. The term of delivery of the goods starts counting from the moment when:
5.3.1. The buyer made payment for the goods, if payment by bank transfer was chosen;
5.3.2. The buyer confirmed the order and received a confirmation message by e-mail, if payment by cash or bank card was selected during the delivery / collection of the goods.
5.4. When the Seller does not have the necessary goods in stock, and the Buyer is informed about the shortage of the goods ordered by him. By approving these Rules, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to immediately contact the Buyer and coordinate the delivery terms and other conditions. If the Seller does not deliver the goods within the set deadline and the Parties do not agree on an additional deadline for the delivery of the goods, the Buyer can use the right to refuse the contract for the purchase of goods or services and get the money back for the ordered goods, if he has already paid for them.
5.5. Deadlines for picking up goods:
5.5.1. After choosing to collect the goods in Dvirtex stores, the goods must be collected no later than within 5 (five) working days, after the Seller informed the Buyer by e-mail or SMS message that the goods can be collected.
5.5.2. After choosing to collect the goods at the DPD PickUp parcel terminal, the goods must be collected no later than within 7 (seven) working days, after the Seller has informed the Buyer by e-mail or SMS message that the goods can be collected.
5.6. The buyer undertakes to accept the goods himself. When accepting goods, it is necessary to present a valid personal identification document (identity card, passport or new model driver's license). If the Buyer cannot accept the goods himself, and the goods are delivered to the address specified by the Buyer, the Buyer has no right to make claims to the Seller regarding the delivery of the goods to the wrong person.
5.7. The seller is released from responsibility for the violation of the deadlines for the delivery of the goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties or due to circumstances beyond the control of the Buyer.
5.8. During the delivery of the goods, together with the Seller's authorized representative, the Buyer must check the condition of the goods shipment. Upon noticing a violation of the shipment, the Buyer must mark it in the consignment note and write a free-form shipment violation act. If the buyer signs the consignment note without comments, it is considered that the shipment has been delivered in good order. If the delivered product does not contain any parts or documents (e.g. warranty card, etc.), the Buyer must immediately inform the Seller about this.
5.9. The goods will be delivered by the Seller or his authorized representative. After the buyer signs the consignment note, it is considered that the consignment has been transferred (delivered) properly.
5.10. After choosing to pick up the goods at partner parcel terminals, the Seller has the right to change the delivery method specified by the Buyer, if, due to the dimensions and weight of the parcel, the parcel cannot be delivered to the DPD PickUp terminal. The Seller informs the Buyer about the change in the delivery method by e-mail or telephone specified in the order.
5.11. If the Buyer does not pick up the goods within the specified period or if they fail to be delivered to the Buyer and the Buyer has paid for the goods and their delivery, the representatives contact the Buyer regarding another time and/or method of delivery of the goods. If the Buyer still does not collect the goods or fails to deliver them, such goods are returned to the Seller, the order is cancelled, and the money paid for the goods is returned to the Buyer.
5.12. If the Buyer does not pick up the goods within the specified period or they fail to be delivered to the Buyer and the Buyer has not paid for the goods, such goods are returned to the Seller and the order is cancelled.
6. REFUSAL OF ORDER, RETURN OF GOODS
6.1. The buyer has the right to withdraw from the contract of sale of goods without giving a reason within 14 (fourteen) days by notifying the seller.
6.2. After more than 14 (fourteen) days have passed from the day of delivery of the goods, the rules of the Retail Trade of the Republic of Lithuania apply to the return of the goods.
6.3. In cases where the Buyer notifies the withdrawal from the sales contract within 14 (fourteen) days of the delivery of the goods, the goods must be returned in their original packaging (labels intact, protective film intact, etc.). The product should be unused, undamaged, clean, without losing its merchandise appearance, properly prepared and packed. This clause does not apply to the return of a defective product.
6.4. When a defective product is returned, the Seller undertakes to pick up the defective product and, in the absence of the Buyer's objection, replace it with an analogous product. If the Buyer objects to the replacement of a low-quality product with a high-quality product, the Seller undertakes to return the money paid for the low-quality product within 5 (Five) working days from the day of return of the Product.
6.5. The buyer has the right to withdraw from the purchase-sale contract by notifying the Seller in writing (by e-mail to info@dvirtex.lt or by filling out the return form on the www.dvirtex.lt page).
6.6. When returning a product, a request must be submitted, specifying the detailed order information: order number, date, product, price, delivery date. The account for the refund must be indicated in the request. In case the money is returned not to the buyer's account, but to another person's account, it is mandatory to present the authorization issued by the buyer to the third party to accept the returned money.
6.7. If the Buyer does not receive confirmation within 1 working day, he must contact Dvirtex.lt by phone. After the buyer has canceled the contract, within 3 (Three) working days he must contact us by phone or e-mail. coordinate with the Seller by mail the method of returning the goods (all issues of picking up, transporting and other transportation of the goods to the place indicated by the Seller). In this case, the Buyer must return the purchased Product that meets the requirements specified in Clause 6.3 of the Rules. Upon cancellation of the contract, the money paid for the Product will be returned within 5 (Five) working days from the day of return of the Product.
6.8. If the Buyer cancels the concluded contract, the Buyer bears the direct costs of returning the goods, unless otherwise agreed with the Seller. This clause does not apply to the return of a defective product.
6.9. The Buyer does not have the right to refuse the purchase-sale contract if the Buyer has damaged the product or substantially changed the appearance of the product; changes to the appearance of the packaging, which were necessary to inspect the received product, are not considered as essential changes to the appearance of the product.
6.10. If, during the warranty period, a product of inadequate quality purchased by the customer is replaced by a new product of adequate quality, the remaining warranty period applies to the replaced product, i.e. the warranty period is not extended.
7. GOOD QUALITY GUARANTEE
7.1. All goods are subject to the manufacturer's warranty terms. The warranty period is specified in the warranty card issued to you or in another equivalent document.
7.2. If the product fails during the warranty period, except for cases where the failure is not the fault of the manufacturer or Dvirtex.lt, the repair is carried out free of charge.
7.3. If the product is damaged, you can contact Dvirtex.lt for warranty repair.
7.4. When submitting the product for repair, the Buyer must provide a document confirming the purchase of the product (invoice - invoice or money receipt).
7.5. The characteristics of each product sold on Dvirtex.lt are indicated in the product name and/or description attached to each product.
7.6. The seller is not responsible for the fact that the size, shape, color or other parameters of the goods on Dvirtex.lt may not correspond to the real size, shape, color or other parameters of the goods due to the characteristics of the display used by the Buyer or other technical reasons beyond the control of the Seller. The buyer is recommended to read the product description or consult with the seller by e-mail, phone or in the store.
7.7. The quality guarantee provided by the seller does not limit or constrain the rights of consumers, which are established for them by legal acts after purchasing a product or service of inappropriate quality.
8. FINAL PROVISIONS
8.1. These Rules are drawn up in accordance with the legal acts of the Republic of Lithuania.
8.2. The Seller reserves the right to suspend, at its own discretion, fill in, change these Rules and other documents related to the Rules, informing the Buyer about this in the online store. Additions or changes to the rules take effect from the date of their publication, i.e. from the day they are placed in the electronic store system.
8.3. Relations arising on the basis of these Rules shall be governed by the law of the Republic of Lithuania.
8.4. All disagreements arising from the implementation of these Rules shall be resolved through negotiations. If an agreement cannot be reached within 30 (thirty) calendar days, disputes are resolved in accordance with the procedure established by the legal acts of the Republic of Lithuania.
8.5. In the event that the Buyer does not agree with the Seller's response to the Buyer's written claim, the Buyer (consumer) can submit his/her request/complaint regarding the goods purchased on Dvirtex.lt to the State Consumer Rights Protection Service (Vilniaus st. 25, 01402 Vilnius, e-mail Mr. tarnyba@vvtat.lt, phone: 85 262 67 51, fax: (85) 279 1466, on the website www.vvtat.lt (also for territorial units of the State Consumer Rights Protection Service in counties) - or fill out the application form on the EGS platform https://ec.europa.eu/odr/.
